      ORDINANCE NO.____                 

  AN ORDINANCE OF THE CITY OF KEY WEST, FLORIDA, AMENDING CHAPTER 93 OF THE CODE OF ORDINANCES ENTITLED "CUSTOM MADE WEARING APPAREL" BY AMENDING SECTION 93.04 TO REQUIRE POSTING OF ADDITIONAL SIGNAGE TO ADVISE CUSTOMERS OF A REMEDY IN THE EVENT OF A PRICE DISPUTE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF INCONSISTENT PROVISIONS; PROVIDING FOR AN EFFECTIVE DATE

 

 

WHEREAS,  the City Commission finds that allegations continue of consumer fraud in tee-shirt shops in the commercial district; and

WHEREAS,  the City Commission desires that tourists and others shopping in these stores fully understand their options in the event a dispute arises over the price of goods; and

WHEREAS,  the City Commission finds that the posting of additional signage in the tee-shirt shops, apprising consumers of their rights, would serve to promote the health, safety and welfare of the citizens of Key West;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF KEY WEST, FLORIDA:

Section 1:    That Section 93.04 of the Code of Ordinances is hereby amended as follows:

Sec. 93.04  Requirements for obtaining a permit.

(b)  In addition, the applicant shall:

(2)  Post at all entrances to its business premises, in plain view in the vicinity of each cash register, on a sign ofcardboard or other similar material, with a white background with one-half-inch block style letters, a two signs issued by the city code enforcement board or licensing office, the following notice: as follows:

WHERE VALUE EXCEEDS $15.00

Section 2.  If any section, provision, clause, phrase, or application of this Ordinance is held invalid or unconstitutional for any reason by any court of competent jurisdiction, the remaining provisions of this Ordinance shall be deemed severable

therefrom and shall be construed as reasonable and necessary to achieve the lawful purposes of this Ordinance.

Section 3.  All Ordinances or parts of Ordinances of said City in conflict with the provisions of this Ordinance are hereby

superseded to the extent of such conflict.

Section 4.  This Ordinance shall go into effect immediately upon its passage and adoption and authentication by the signature of the presiding officer and the Clerk of the Commission.
